JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-04-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 is husband whereas petitioner no. 2 is father in law of the deceased.
The informant has disclosed the date of marriage of the deceased as 09.06.2014 in her written report but in further statement it appears that she disclosed the date of marriage of the deceased as 08.06.2009.
Admittedly, deceased died on 08.06.2014. The informant has admitted in her written report that she got information about the serious condition of her daughter from the petitioners and it is also an admitted position that deceased was taken to one Dr. Shiv Shankar by the petitioners and
Patna High Court Cr.Misc. No.44093 of 2014 (4) dt.23-04-2015 thereafter, the aforesaid Dr. Shiv Shankar referred the deceased to Sadar Hospital but unfortunately, deceased died. The cause of death of the deceased could not be ascertained and no external or internal injury was found on the person of the deceased. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Brahmpur P.S. Case No. 145 of 2014.
