The petitioner seeks pre-arrest bail in connection with Rani Talab P.S. Case No. 21 of 2015 registered under Sections 147, 148, 149, 341, 323, 324, 504 and 307 of the Indian Penal Code.
It is contended that co-accused Gautam Kumar whose case is identically situated to that of the petitioner has already been granted anticipatory bail by reasoned order vide order dated 16.10.2015 passed in Cr. Misc. No. 48438 of 2015 by a co-ordinate Bench of this Court.
Patna High Court Cr.Misc. No.2200 of 2016 (2) dt.18-01-2016 2 / 2 Learned counsel for the State concedes that the similarly circumstanced co-accused Gautam Kumar has been granted anticipatory bail.
Regard being had to the reasons assigned in the aforesaid order dated 16.10.2015, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Danapur, Patna in connection with Rani Talab P.S. Case No. 21 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
