The petitioner is accused in connection with Udawantnagar P.S. Case No. 136 of 2014, registered under Section 25(10-b)a, 26(i), 26(ii) and 35 of the Arms Act. The accusation is that on receiving the confidential information regarding presence of absconder accused Upendra Choudhary along with two others at his house. The Police party reached there, out of them two miscreants succeeded to flee away, but Upendra Choudhary was apprehended with country made rifle, who also disclosed the name of his two associates as Butan Choudhary (Petitioner) and Dippu Choudhary.
Patna High Court Cr.Misc. No.4877 of 2017 (2) dt.03-03-2017 2/2 Learned counsel for the petitioner submits that, in fact, petitioner is accused in 10 other cases, as detailed in para03 of the petition, and due to that reasons the petitioner has falsely been implicated in this case. Moreover, the petitioner is in custody in the preset case since 10.03.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in connection with Udawantnagar P.S. Case No. 136 of 2014. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
