The petitioner who happens to be nephew of the informant had gone to the place of the informant, made night halt and during course thereof, committed theft of the articles so listed therein. However, misfortune followed as the petitioner was apprehended by the G.R.P., Raghunathpur along with the stolen articles.

Learned counsel for the petitioner has submitted that the articles have not put on T.I. parade so, the petitioner be released on bail.

The learned Additional Public Prosecutor controverted the submission and submitted that there happens to be specific disclosure in the written report itself that when the

Patna High Court CR. MISC. No.9579 of 2020(2) dt.05-03-2020 2/2 informant came to know about the apprehension of a theft with stolen articles, she had gone to Raghunathpur Station where had seen the petitioner whom she identified and articles which were seized from his possession.

Accordingly, the prayer for bail is rejected. However, after examination of the informant Janki Devi the learned lower court will release the petitioner on bail to its own satisfaction. (Aditya Kumar Trivedi, J) skpathak/- U T
