2. The petitioner has prayed for bail in Wazirganj P.S. Case No. 185 of 2024 registered for the offence punishable under sections 302, 201/34 of the Indian Penal Code.

3. As per allegation in the FIR, informant's sister was married to the petitioner in November, 2016 and out of their wedlock, they are blessed with three children. It is further alleged that she was being tortured and harassed at her matrimonial home by in-laws and husband and ultimately she was done to death on 26.03.2024.

4. It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case only because he happens to be the husband of the deceased. In fact,

Information of death was given to parental home of the deceased twice through mobile, mentioned in the FIR, which shows bonafide intention and fair conduct of the petitioner. Deceased's family members from her parental home have participated in funeral of the deceased. After completion of investigation, chargesheet has been submitted against the petitioner. Petitioner has got no criminal history and languishing in judicial custody since 26.03.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st Gaya in connection with Wazirganj P.S. Case No. 185 of 2024.
