2. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 147, 149, 341, 323, 324, 354B, 379, 504 and 427 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.
3. As per prosecution case, cow of this petitioner was grazing in the field of the informant and on protest, all the accused persons named in the F.I.R., including this petitioner, entered the courtyard of the informant and assaulted him with kicks and sticks. It is further alleged that co-accused Akalima snatched silver chain from the neck of the informant.
4. It is submitted by learned counsel appearing on behalf of the petitioner that due to grazing of paddy crops of the informant, some altercation took place between the parties.
Patna High Court CR. MISC. No.14180 of 2024(4) dt.09-07-2024 2/2 Petitioner is a lady and there is no specific allegation of assault against her. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the aforesaid facts and circumstances, nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Amour P.S. Case No.342 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
