JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but he was not caught on the spot and it is only stated that some criminals were assembled in the house of the petitioner and when police party reached there, they made firing on the police party. Admittedly, none has sustained any firearm injury and the person, who was caught on the spot, has already been granted privilege of bail by a co-ordinate Bench of this Court. No doubt, petitioner carries criminal antecedent of several cases but submission on behalf of the petitioner is that the petitioner has been made accused in almost all the cases at the behest of the police. Considering the aforesaid facts and circumstances as

No.43969 of 2014 (4) dt.23-04-2015 well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 28.11.2012, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Sono P.S. Case No. 38 of 2005.
