JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 18-01-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Nokha P.S. Case No. 228 of 2015 registered under Sections 147, 148, 149, 307, 504, 506 and 323 of the Indian Penal Code and Section 27 of the Arms Act.
It is contended that there is general and omnibus allegation against the petitioners and the specific allegation of causing injury to the son of the informant Arbind Kumar @ Bigu is against Mithilesh Singh. It is further contended that a counter case was also instituted against the members of the
Patna High Court Cr.Misc. No.2171 of 2016 (2) dt.18-01-2016 2 / 2 prosecution party being Nokha P.S. Case No. 229 of 2015 dated 13.11.2015 registered under Sections 147, 148, 149, 307, 504, 506, 341 and 323 of the Indian Penal Code as also Section 27 of the Arms Act on the basis of a written report submitted by coaccused Mithilesh Kumar. Learned counsel for the State has opposed the application for grant of anticipatory bail to the petitioners. Regard being had to the fact that there is a cross case as also the fact that the specific allegation of causing injury to the son of the informant is confined against Mithilesh Kumar, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sasaram in connection with Nokha P.S. Case No. 228 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
