Petitioner is accused in connection with Aurangabad P.S. Case No. 112 of 2015 registered under Sections 394 of the I.P.C and 27 of the Arms Act.

It is submitted that petitioner has been falsely implicated in the present case as he is not named in the FIR. His name has come only on confessional statement of the co-accused and no Test Identification Parade has been held. He is in custody since 14.05.2016. Also similarly situated co-accused has been granted bail in Cr. Misc. No. 54646 of 2016 vide order dated 23.12.2016.

Having considered the facts and circumstances of the

Patna High Court Cr.Misc. No.1977 of 2017 (3) dt.27-03-2017 case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad P.S. Case No. 112 of 2015.
