JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-04-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are not named in the first information report and it would appear from the first information report that two persons were killed by one Maina Singh and others and in retaliation to the aforesaid murder, the local people became agitated and set one truck on fire. Furthermore, it would appear from the case diary that unfortunately, brother of aforesaid Maina Singh came there and mob caught the brother of aforesaid Maina Singh and threw him on burning truck as a result of which he was caught in fire and died there. The name of petitioners surfaced in
Patna High Court Cr.Misc. No.48460 of 2014 (4) dt.23-04-2015 this case in course of investigation but no specific overt-act has been attributed against them. It would appear from perusal of the case diary that it was one Bhagwan Paswan who set the truck on fire. Moreover, some co-accused have already been granted privilege of bail by the learned court below itself. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Cheriya Bariyarpur P.S. Case No. 12 of 2010.
