The petitioner is apprehending arrest in a case registered for the offences punishable under section 379 of the Indian Penal Code.
Theft was committed in train leading to registration of preset case against unknown. Subsequently, the alleged theft mobile was recovered from the petitioner when he was caught but subsequently he was released.
It is submitted by the learned counsel for the petitioner that on recovery of the mobile the petitioner was released since it was found that the petitioner is bonafide
Patna High Court Cr.Misc. No.4125 of 2016 (2) dt.29-01-2016 2/2 purchaser of the alleged mobile. There is nothing on record to suggest that the petitioner was actually arrested. Considering the nature of accusation, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Barauni Rail P.S. Case No. 14 of 2014 pending in the court of learned Railway Judicial Magistrate, Barauni (Begusarai).
This application is disposed of with the aforesaid observation/direction.
