The petitioner seeks bail in anticipation of his arrest in connection with Ghoshi (Okari) P.S. Case No. 395 of 2019, dated 04.11.2019, instituted for the offences under Sections 147, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

The petitioner is alleged to have assaulted the father of the informant by means of a Garasa. The father of

Patna High Court CR. MISC. No.20303 of 2021(2) dt.15-04-2022 2/3 the informant appears to have received two injuries, one of which has been assessed to be simple in nature. With respect to the other injury, the opinion has been reserved pending further medical examination.

It has however been submitted on behalf of the petitioner that the dimension of such injury does not at all give an impression that it could ever be called grievous as it is on the middle finger of one of the hands of the victim. It has further been submitted that his father had also filed a complaint against the informant of the present case and others in which cognizance has been taken by the learned Chief Judicial Magistrate, Jehanabad.

It further appears that a dispute arose between the parties because of construction of a house over disputed plot of land.

Considering the afore-noted background facts, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two

No.20303 of 2021(2) dt.15-04-2022 3/3 sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Ghoshi (Okari) P.S. Case No. 395 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
