2. The petitioner seeks bail in connection with Kalyanpur PS Case No. 02 of 2023 instituted for the offences punishable under Sections 341, 342, 323, 324, 307, 379, 504, 506, 120(B) of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is that he assaulted the informant with dabia on his head with an intention to kill him.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case merely on the basis of dirty village politics. Petitioner is named in the FIR and the entire prosecution story is false, fabricated and concocted. Petitioner is

5. Learned APP opposes the prayer for bail.

6. From perusal of the FIR, case diary, injury report as well as the impugned order of the learned Additional Sessions Judge-XVI, Motihari, East Champaran dated 19.12.2023, it appears that petitioner is named in the FIR and the injury report of the informant shows that he sustained lacerated wound on left side of frontal head 1"x1/4"x deep skin, lacerated wound on left side of frontal head 1/4" besides other injuries and the period of custody, accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, East Champaran, Motihari in connection with Kalyanpur PS Case No. 02 of 2023.
