JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-03-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Mairawa P.S. Case No. 283 of 2019 for offences under Sections 341, 323, 308, 379 and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. The allegation against the petitioners is that they have assaulted the informant, took away cash of Rs.16,684/- and snatched a gold chain worth Rs.45,450/- from the informant.

Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.8116 of 2020(2) dt.02-03-2020 2/2 wife of petitioner no. 1 lodged an FIR against the informant's side bearing Mairawa P.S. Case No. 285 of 2019. He further submits that petitioner nos. 1 and 2 are Government teachers and petitioner no. 3 is a student.

Considering the fact that there is case and counter case for the occurrence of the same date and petitioner nos. 1 and 2 are Government teachers and petitioner no. 3 is a student, this Court is inclined to grant bail to them. Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Mairawa P.S. Case No. 283 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
