The petitioner seeks bail in Tandwa P.S. Case No. 26 of 2014, registered for the offences punishable under Sections 364, 498 and other Sections of the Indian Penal Code. The informant made allegation that the petitioner forcibly kidnapped his wife Sunita Devi along with his child aged about two years, his wife was having ornaments worth of Rs. 50,000/-.

Learned counsel for the petitioner submits that the entire allegation is false and concocted. The victim herself left her house on being assaulted by her husband. She solemnized marriage with Alok @ Avinash Singh, the petitioner. She further disclosed in her statement under Section 164 of the Cr.P.C. that

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Tandwa P.S.
