The petitioner seeks bail in Jamalpur P.S.

Case No. 144 of 2016 instituted for the offence under Sections 379, 411 of the Indian Penal Code.

It is alleged that petitioner took out Rs.

600/- from the pocket of the informant. It is further alleged that petitioner also attempted to take out Samsung mobile from the pocket of the informant but he was caught. It has been submitted on behalf of the petitioner that from the seizure list, it appears that articles alleged to have been recovered from the possession of the petitioner were, in fact, handed over to the police by the informant himself. From the seizure list, it is clear that no recovery has been made by the police from the possession of this petitioner. It has been mentioned in para 3 of the petition

Patna High Court Cr.Misc. No.2975 of 2017 (2) dt.06-02-2017 2/2 that petitioner has no criminal antecedent and petitioner is in custody since 28.10.2016.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Munger in connection with Jamalpur P.S. Case No. 144 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
