The instant application for anticipatory bail has been filed by the petitioner apprehending her arrest in connection with Marhowrah (Goura) P.S. Case no. 730 of 2019 instituted for the offence punishable under Section 304(B)/34 of the Indian Penal Code.

The prosecution case relates to dowry death due to non-fulfillment of dowry demand of motorcycle as dowry. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is aunt (in-laws) of the deceased. It is further submitted that she has no concern with the daily activity of the husband and wife as they live separately. It is stated that co-accused stands on similar footing namely Urmila

Learned APP for the State has opposed the prayer of bail.

Having heard learned counsel for the parties and the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of her arrest or surrender in connection with Marhowrah (Goura) P.S. Case No. 730 of 2019, she will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ 6th, Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
