JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he along with several other F.I.R. named accused made indiscriminate firing as a result of which informant sustained firearm injury. Subsequently, the other injured were also assaulted by the F.I.R. named accused and one co-accused, Nandlal Yadav opened fire causing firearm injury to father of the informant. The contention on behalf of the petitioner is that all the injured sustained simple injury and as a matter of fact, there was case and counter case between the parties and persons from both the side sustained injury and therefore, it appears that due to free fight parties sustained injury.
Patna High Court Cr.Misc. No.54772 of 2015 (2) dt.09-12-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur in connection with Bihta P.S. Case No. 467 of 2015.
