JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2017 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are languishing in custody in connection with Bela P.S. Case No. 164 of 2016 for the offences punishable under Sections 8/20(b)(i)(B) of Narcotic Drugs & Psychotropic Substances Act.

Three persons on a motorcycle were apprehended along with ganja to the tune of 3.7 Kg. The petitioners were motorcycle riders and they are in custody since 05.11.2016. After hearing the parties and considering the nature of allegation, I am not inclined to enlarge the petitioners on bail. The

Patna High Court Cr.Misc. No.4068 of 2017 (3) dt.10-04-2017 2/2 prayer for bail of the petitioners is refused. However, the learned Court-below is directed to expedite the trial. If the trial is not concluded within one year of the custody of the petitioners, the petitioners may renew the prayer for bail before the learned trial Court itself.
