JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 17-03-2025 In the instant petition, petitioner has prayed for the following relief(s):- i) For issuance of a writ in the nature of "certiorari" for quashing the order dated 20.05.2017 passed in L.A. Case No.21 of 2014-15 by the learned Arbitrator cum Additional Collector, Aurangabad whereby and where under the order passed by the competent authority as D.C.L.R., Aurangabad and has been affirmed and the claim of the petitioner for prayer of compensation of his land being commercial land has been rejected. ii) For directing the concerned respondent authorities to pay the compensation of land acquired at commercial rate as the land of the

2. Learned counsel for the petitioner after some argument submits that this case may be disposed of with the liberty to the petitioner to approach before the appropriate authority.

3. Learned counsel for the State and NHAI have no objection to this prayer of the petitioner.

4. In view of the submissions of learned counsel for the parties, the present writ petition stands disposed of with the liberty as prayed for.
