The petitioner apprehends his arrest in a case registered for the offences punishable under Section 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he got a Passion Pro motorcycle from his father-inlaw as gift at the time of marriage which he had parked on 31.05.2020 in the night but in the morning the bike was not found and thus it is alleged that informant came to know that petitioner and co-accused (Lokesh Kumar) had stolen the motorcycle which was worth Rs. 40,000/-.

Learned counsel for the petitioner submits that the

No.10268 of 2022(2) dt.06-09-2022 2/2 petitioner has been falsely implicated in the present case, it is next submitted that there is nothing in the FIR to remotely suggest that how informant came to know that it was this petitioner along with Lokesh who had committed the occurrence, it is also submitted that the matter has been compromised, as it has been specifically pleaded at Para-8 of the anticipatory bail application.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mahkar P.S. Case No. 50 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
