The petitioner is accused in connection with Fulwaria P.S. Case No. 162 of 2016, registered under Sections 272, 273, 420/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of checking of the vehicles, both petitioners were found sitting on the motorcycle. On search, 90 bottles, each containing 200 ML, country made liquor kept in two bags recovered from the possession of the petitioners.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.4835 of 2017 (2) dt.02-03-2017 2/2 petitioners have falsely been implicated in this case. Further submission is that petitioners have no criminal antecedent are in custody since 14.12.2016.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Fulwaria P.S.
