JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 15-12-2015 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner seeks bail in connection with Nawkothi P.S. Case No. 53 of 2015 registered under Sections 386 and 504 read with 34 of the Indian Penal Code and Section 3(2)(v) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act.

It is contended that the present case has been instituted in retaliation to the complaint made by the petitioner before the District Magistrate, Begusarai as well as the Lokayukta, Bihar against the mal-practices and manipulation of

Patna High Court Cr.Misc. No.56105 of 2015 (2) dt.15-12-2015 2 / 2 public money by the informant. It has further been contended that the petitioner is in custody since 1st October, 2015 and on completion of investigation, the police have already been submitted charge-sheet in the Court. It is also contended that the petitioner has got roots in the society and is not likely to abscond or tamper with the evidence.

Learned counsel for the informant has vehemently opposed the application filed on behalf of the petitioner. He has contended that the allegation of terrorizing the informant and taking away Rs. 2,000/- from his pocket has duly been corroborated by one Chandan Singh who had witnessed the occurrence.

Be that as it may, regard being had to the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Begusarai in connection with Nawkothi P.S. Case No. 53 of 2015.
