JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Jamo Bazar P.S. Case No.130/16 registered under Sections 147, 148, 149, 341, 323, 353 and 504 of the I.P.C.

Accusation is that on receiving the information about the occurrence of mar pit in village Tole Jalalpur in between the petitioner and his Patidars. the informant along with the other police official reached in village Tole Jalalpur at 9.45 P.M. on 15.11.2016. When the informant asked to Nathuni Sah about the occurrence, then he told that his patidars named in the F.I.R. including the petitioner were forcibly putting pillars in his land behind his house and upon protest they started mar pit with me. When the informant made query to this petitioner then he started

Learned counsel for the petitioner submits that, in fact, hot talks were exchanged in between Nathuni Sah and the accused, named in the F.I.R., including the petitioner regarding the land dispute. The informant and other police officials reached on the spot and started abusing the petitioner and others and on protest the present case is lodged with a false allegation. Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Siwan, in Jamo Bazar, P.S.
