Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-04-2022 Heard Mr. Lal Babu Singh, learned advocate for the petitioner. The State is represented by learned Additional Public Prosecutor.

The petitioner seeks bail in anticipation of her arrest in connection with Ekangarsarai P.S. Case No. 250 of 2020 (G.R. No. 2404 of 2020) dated 16.09.2020 instituted for the offences under Sections 341, 323, 325, 338, 307, 504, 506 and 34 of the Indian Penal Code.

The Informant and his son were assaulted by all the accused persons including the petitioner.

Hence the case.

The learned counsel for the petitioner submits that there is specific accusation against her husband of having assaulted the Informant when he had gone to rescue his son.

So far as the petitioner is concerned, there is no specific accusation against her. In fact, her husband and the Informant are cousins and because of some dispute, an occurrence took place but the Informant has chosen to implicate the entire family of the petitioner.

Considering the aforenoted background facts and the general nature of accusation as also the gender of the petitioner, she is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa in connection with Ekangarsarai P.S. Case No. 250 of 2020 (G.R. No. 2404 of 2020), subject to the conditions as laid down under Section 438(2) Cr.P.C.
