ANJANA MISHRA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is a rice miller who is apprehending his arrest in Sheohar P.S. Case No. 88 of 2015 registered for the offences punishable under Section 420, 406, 409 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that there is allegation of defalcation of CMR valued at Rs. 84,64, 282.40/-. He further submits that out of the aforementioned amount the petitioner is ready and willing to deposit 20% of the alleged defalcated amount within a period of

Patna High Court Cr.Misc. No.2473 of 2016 (4) dt.26-04-2016 2/2 six months in equal installments and shall deposit first installment within a period of four weeks from the date of receipt of a copy of this order.

Considering the aforesaid submissions, let the petitioner, in the event of his arrest of surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is/are directed to be enlarged on bail on furnishing bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S Case No. 88 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
