JUSTICE DINESH KUMAR SINGH ORAL ORDER 07/ 07-03-2018 The petitioner has renewed the prayer for bail in a case registered for the offences punishable under Sections 147, 148, 149, 302, 341 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that all the accused persons resorted to firing, as a result the brother-in-law of the informant succumbed to the injury.

Considering the fact that the case was registered in 1998 and the petitioner was arrested on 03.12.2014 the earlier prayer for bail of the petitioner was rejected vide order dated 04.02.2015 passed in Cr. Misc. No. 4607 of 2015. However, the petitioner was granted provisional bail for three weeks vide

Patna High Court Cr.Misc. No.8028 of 2017 (7) dt.07-03-2018 order dated 28.04.2016 passed in Cr. Misc. No. 11195 of 2016, but defaulted at that time also, though he was subsequently arrested on 29.07.2016.

The report of Superintendent of Police, Munger dated 04.01.2018 at Flag 'E' suggests that all the witnesses except one charge sheet witness, who has been given up by the prosecution, have been examined and the prosecution evidence has already been closed.

In view of the present stage of trial, this Court is not inclined to interfere, hence, it is expected from learned Vth Additional Sessions Judge, Munger to conclude the trial of Sessions Trial No. 986A of 1999 arising out of Muffasil P.S. Case No. 122 of 1998, expeditiously, preferably within a period of three months.
