Petitioner is accused in connection with Patahi P.S. Case No.126 of 2014 registered under Sections 302, 201 and 34 of the I.P.C.

Submission is that on recovery of unknown dead body, Patahi P.S. Case No. 126 of 2014 was instituted under sections 302, 201 and 34 of the I.P.C. which was identified as Mantu Patel by his brother Budhan Patel. Thereafter, on 12.12.2014, Sarita Devi, wife of the deceased, gave an application to the effect that petitioner along with one Bala Das had come at her house to hire Tempo, but her husband refused to go with them saying that he would go to Motihari for depositing the installment

Patna High Court Cr.Misc. No.55416 of 2015 (3) dt.11-02-2016 2/2 of the loan of the Tempo in the Bank, Motihari, but on persuasion, he proceeded for Motihari along with them, since then her husband was traceless. Except suspicion, there is nothing against the petitioner. It is also submitted that petitioner has no criminal antecedent and is in custody since 06.08.2015. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Motihari, District East Champaran in connection with Patahi P.S. Case No. 126 of 2014.
