JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 20.3.2014 in a case registered for the offences punishable under sections 364A,341 and 346/34 of the Indian Penal Code. It is alleged that the son and the minor grand son of the informant went traceless. Subsequently, the grand son of the informant namely, Chandan was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the boy was kept at the house of the petitioner and the grand son of the informant suggested that he was kidnapped by co accused Akhilesh Kumar Singh who kept the victim boy at the house of this petitioner.

Patna High Court Cr.Misc. No.29049 of 2014 (5) dt.05-05-2015 2/2 Considering the nature of accusation and the fact that the son of the informant is still traceless, this court is not inclined to grant bail to the petitioner.

This application is, accordingly, dismissed.

However, let the trial be expedited in connection with Morkahi P.S. Case No. 62 of 2013 pending in the court of learned C.J.M., Khagaria.
