The petitioner seeks bail in a case registered for the offence under Sections 427, 353, 384 of the Indian Penal Code. It is submitted on behalf of petitioner that as per F.I.R., petitioner has been made accused in this only on the basis of CCTV footage and was found raising slogan and coming out of the chamber of President of Zila Parishad. It is further submitted that F.I.R. has been lodged after a delay of six days without any plausible explanation. In fact, wife of the petitioner is Zila Parishad Member and petitioner had taken her to the venue of special meeting to facilitate her participation in 'No Confidence Motion' against the President of the Zila Parishad. Petitioner claims clean antecedent and he is in custody since 15.12.2021.

Patna High Court CR. MISC. No.9768 of 2022(2) dt.21-04-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Kotwali (Jogsar) P.S.
