2. The petitioner apprehends his arrest in connection with Phulaut P.S. Case No. 14 of 2025, instituted under Section 87 of the B.N.S.
3. As per the prosecution case, petitioner is alleged to have kidnapped the minor daughter of the informant with the help of four co-accused persons with intention to marry with her.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The victim in her statement has not made any allegation
Patna High Court CR. MISC. No.18338 of 2026(3) dt.13-05-2026 2/2 against the petitioner. She has stated that she voluntarily eloped with the petitioner and married with him and residing together. Petitioner is aged about 23 year having no criminal antecedent. Petitioner undertakes to co-operate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case, submission of learned counsel for the parties and statement of the victim, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Udakishunganj, Madhepura in connection with Phulaut P.S. Case No. 14 of 2025, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
