JUSTICE SHIVAJI PANDEY ORAL ORDER 04-09-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing. In this case, the petitioner is seeking anticipatory bail in connection with Samho P.S. Case No. 24 of 2019 registered for offence punishable under sections 447, 342, 323, 307, 354, 504 read with section 34 of the Indian Penal Code. Allegation has been made against the petitioner to have caused injury by iron rod to the informant's son namely Bittu Singh.

The learned counsel for the petitioner submits that the injury is simple in nature, but from the injury report it reflects that the injury has been caused on the head of informant's son by hard and blunt substance. The police has also found the allegation against the petitioner to be proved and submitted the

In such view of the matter, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by this order will take decision in accordance with law, preferably on the same day.
