JUSTICE BIRENDRA KUMAR ORAL ORDER 20-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 366/379 of the Indian Penal Code.

Wife of Sahin Akhtar was found missing from her house along with ornaments and cash. Later on it revealed that she had gone along with Md. Imran, the brother of this petitioner. The victim girl on recovery stated under Section 164 Cr.P.C. that Md. Imran had come to her house at 4:00 PM, she took tea and became unconscious. Thereafter she found herself in hotel where the petitioner was also there. The police came and she was recovered.

Patna High Court Cr.Misc. No.3624 of 2017 (2) dt.20-02-2017 2/2 Submission is that the matter appears to be of love affairs.

Learned Additional Public Prosecutor opposes the prayer on the ground that the bail prayer of co-accused Md. Imran has been refused.

Considering the nature of allegation, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Rina Kumari, Judicial Magistrate, 1st Class, Patna/Successor Court, in connection with Buddha Colony P.S. Case No. 28 of 2016.
