The allegation against the petitioner is to run away from the place of occurrence, from where 25 liters of country made liquor was recovered, on police raid.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.10209 of 2022(2) dt.13-06-2022 2/3 submitted that nothing incriminating has been recovered from the conscious physical possession of the petitioner. It has also been submitted that chargesheet has already been submitted in this case, as such there is no chance of tampering with the evidence and moreover, petitioner is a man of clean antecedent. Learned APP appearing on behalf of the State while opposing the prayer for bail fairly conceded that nothing incriminating has been recovered from the conscious physical possession of the petitioner.
