The petitioner seeks bail in connection with Sessions Trial No.366 of 2016, arising out of Pulparas P.S. Case No.10 of 2016, registered under Sections 363, 366(A) and 120(B) of the Indian Penal Code, pending in the court of the Additional Sessions Judge-I, Madhubani.

The accusation is that the petitioner, being the tutor of the minor sister of the informant, enticed away the minor sister of the informant for the purpose of marriage.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case.

Patna High Court Cr.Misc. No.1906 of 2017 (5) dt.30-03-2017 2/2 In fact, the victim, the minor the sister of the informant, left the house with this petitioner according to her own sweet will and the petitioner is in custody since 02.02.2016.

On the other hand, learned A.P.P. for the State opposed the prayer of the petitioner for grant of bail with the submission that the victim, the minor sister of the informant, in her statement, as recorded under Section 164 of the Code of Criminal Procedure, has not only supported the prosecution case of her kidnapping by this petitioner but she has also stated about committing rape on her by this petitioner, which is detailed in paragraph-61 of the case diary.

Having regard to the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected.
