The petitioner being the Father of the husband of the complainant apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323 and 498A of the Indian Penal Code.
The basic accusation is of torture and driving out the complainant from the matrimonial house.
It is submitted by learned counsel for the petitioner that the petitioner claims to be separate from the husband of the complainant and the thrust of accusation is against the husband of the complainant.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest
Patna High Court Cr.Misc. No.1289 of 2016 (2) dt.11-01-2016 or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in connection with Complaint Case No.1768-C of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
