On query of the Court with regard to the stage of case, the learned counsel for the petitioners submit that despite best endeavour he was not able to seek instruction in the matter as to whether cognizance has been taken in the case or not after the order by which complaint was dismissed was reversed in revision by the learned Sessions Judge.

3. The learned counsel for the petitioners at this stage

Patna High Court CR. MISC. No.9501 of 2017(2) dt.20-09-2023 2/2 seeks permission to withdraw the quashing application with liberty to assail the order of cognizance, if taken.
