In this case, the petitioner is seeking regular bail in connection with Sessions Trial No.404 of 2013, arising out of Harlakhi P.S. Case No.07 of 2013, registered for the offence punishable under Sections 302 and 201 of the Indian Penal Code. As per the FIR, allegation has been made that the petitioner and his wife were not keeping good relation. It has been alleged that the petitioner killed his wife by sharp cutting weapon. It appears that in the present case the trial is at advance stage. From the order-sheet itself it appears that some witnesses have been examined including the son of the petitioner, who has supported the case of the prosecution.
Patna High Court Cr.Misc. No.56946 of 2015 (3) dt.09-02-2016 2/2 Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the Trial Court is directed to conclude the trial as early as possible preferably within a period of nine month from the date of receipt / production of a copy of this order.
