JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is accused in connection with Obra P.S. Case No. 48 of 2015 registered under Section 302/34 of the I.P.C. The allegation of informant, Meena Devi, is that on 30.05.2015, her husband, Nanhe Dom and Raj Kumar Dom had gone to clean drains near Rath Durga Chowk. Thereafter, Raj Kumar Dom, informed her that Munna Dom, Karan Dom, Gajadhar Dom and Manoj Dom caught hold her husband, in the meantime, Munna Dom and Karan Dom cut the neck of Nanhe Dom, husband of the informant, through fasuli. The petitioner also said to be involved in the occurrence.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.54683 of 2015 (3) dt.11-01-2016 2/2 submits that there is specific allegation against co-accused Munna Dom, Karan Dom, Gajadhar Dom and Manoj Dom to caught hold the deceased and the injury was caused by Munna Dom and Karan Dom. The name of the petitioner has been disclosed by the informant mere on suspicion. It is also submitted that Raj Kumar Dom in the statement before the Police has specifically stated that Munna Dom and Karan Dom caught hold the husband of informant and cut the neck. It is further submitted that petitioner has no criminal antecedent and is in custody since 31.08.2015. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Daudnagar, Aurangabad in connection with Obra P.S. Case No. 48 of 2015.
