ANJANA MISHRA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
Petitioner is apprehending his arrest in connection with Complaint Case No. 2173 of 2013 registered for the offences punishable under Section 323,420/34 of the Indian Penal Code and 138 of the Negotiable Instrument Act.
Notices earlier issued to O.P.No.2 and it appears from the office note that the learned counsel appearing in the court on behalf of O.P.No.2 has already received notice but there is no representation on her behalf as on date.
After hearing the learned counsel for the petitioner
Patna High Court Cr.Misc. No.4132 of 2016 (3) dt.22-04-2016 and learned counsel appearing on behalf of State, it appears that the petitioner is ready to return back the money which he has taken, as such let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Ist Class Judicial Magistrate, Gaya in connection with Complainant Case No. 2173 of 2013 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
