2. The petitioner has preferred this application for grant of regular bail in connection with Muffasil P.S. Case No. 346 of 2024 dated 22.09.2024 registered for the offences punishable under Sections 20 and 29 of the Narcotic Drugs and Psychotropic Substance Act.

3. As per the prosecution case, total 12.132 Kg of ganja was recovered from the Toto vehicle.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has transpired in this case

Patna High Court CR. MISC. No.9047 of 2025(2) dt.18-03-2025 2/2 merely on suspicion. No incriminating article has been recovered from the conscious possession of the petitioner. The seized contraband is less than commercial quantity. The petitioner is the driver of the seized vehicle. The petitioner has no concern with the alleged recovery. The petitioner has no criminal antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 23.09.2024. The co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 15.02.2025 passed in Cr. Misc. No. 4197 of 2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Munger in connection with Muffasil P.S. Case No. 346 of 2024.

7. The application stands allowed.
