2. Petitioner seeks regular bail in connection with Hayaghat P.S. Case No. 131 of 2023, dated 30.08.2023, registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.
3. The main submissions advanced by learned counsel for the petitioner are that as per allegation, only a mobile phone is said to have been recovered from the possession of this petitioner, though, a loaded pistol is alleged to have been recovered but the same is recovered from the possession of the co-accused Saurabh Kumar Singh and not from the possession of this petitioner. Further submissions are that the petitioner has been languishing in jail since 31.08.2023
Patna High Court CR. MISC. No.11646 of 2024(2) dt.28-02-2024 2/2 and against him, there is criminal antecedent of one case in which he is on bail and the seized mobile phone belongs to the petitioner and against him, the investigation has been completed.
4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.
5. In the facts and circumstances of this case and considering the above submissions coupled with the nature of allegation as well as completion of investigation against the petitioner, this Court is inclined to accept the bail prayer of the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Hayaghat P.S. Case No. 131 of 2023.
