The F.I.R. under Section 395 of the Indian Penal Code is against unknown. The name of the petitioner has transpired in the confessional statement of co-accused Mokhtar Alam. The petitioner has stated on oath that he has no criminal antecedent and he is in custody since 19.10.2016 and nothing has been recovered from possession of the petitioner. Moreover, the petitioner has not been put on T.I. Parade.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in
