JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Runnisaidpur P.S. Case No. 02 of 2015 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The police, on receiving secret information about staying of petitioner wanting in murder case with the miscreants, the police reached at the hose of petitioner. While one person succeeded to flee away but three persons were caught hold in the house of the petitioner with country made pistol with cartridge, who disclosed that this petitioner succeeded to fled away from his house and one country made pistol was also found the beneath of the bed of the petitioner.

Patna High Court Cr.Misc. No.55135 of 2015 (3) dt.01-02-2016 Learned counsel for the petitioner submits that, in fact, petitioner is accused in 10 other cases due to that reason, the police has implicated the petitioner in the present case with false allegation. It is further submitted that petitioner is in custody since 18.02.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No. 02 of 2015, subject to the condition that one of the bailors will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
