JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 14-10-2025 At the very outset, learned counsel for the petitioners has submitted that during pendency of this application, the petitioner No. 3 has been arrested and hence, by order dated 1308-2025, the present application with regard to the petitioner No. 3 has been ordered to be withdrawn. Now the present application confines to the petitioner Nos. 1 & 2.
2. Heard learned counsel for the petitioner nos. 1 & 2 and learned APP for the State.
3. The petitioner nos. 1 & 2 are apprehending their arrest in Saraiya (Jaitpur O.P.) P.S. Case No. 518 of 2021 registered under Section 304B/34 of the Indian Penal Code.

3. According to allegation, the marriage of the deceased was solemnized with the co-accused, Sonu Sahani. It has been alleged that the accused persons set the victim ablaze and to save their skin, they admitt4ed her in SKMCH, Muzaffarpur.
4. It has been submitted on behalf of the petitioner Nos. 1 and 2 that they are mother-in-law and brother-in-law (Devar) of the deceased respectively. They have no concern from day to day affairs of the couple. They have falsely been made accused in the present case. It has further been submittetd that as a matter of fact, the deceased had committed suicide and when the matrimonial in-mates found her in injured condition, in order to save her life, have shifted her to SKMCH. It has also been submitted that husband of the deceased is already under custody.
5. On the other hand, learned APP for the State has opposed the prayer for bail.
6. From the FIR itself, it transpires that the petitioners brought the deceased to hospital when she was in injured condition in order to save her life.
7. Considering the aforesaid facts and circumstances, let the petitioner Nos. 1 & 2, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be released on anticipatory bail on furnishing bail

No.10607 of 2025(8) dt.14-10-2025 3/3 bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, (West), Muzaffarpur in connection with Saraiya (Jaitpur O.P.) P.S. Case No. 518 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/482(2) of BNSS, 2023.
