The present writ petition has been filed seeking the following relief:- "That this is an application for issuance of appropriate writ order or direction to the respondents to appoint the petitioner on the post of constable at Jamui District and for grant of all consequential benefits."

At the outset, the learned counsel for the respondent has referred to the counter affidavit filed in the present case to submit that the petitioner did not submit his joining on the date fixed for joining and had remained absent allthroughout, whereafter, he had belatedly submitted his joining

Patna High Court CWJC No.18308 of 2015 dt.27-09-2023 2/2 after about two months, thus the candidature of the petitioner had been cancelled.

The learned counsel for the respondent has also submitted by referring to paragraph no.9 of the counter affidavit filed in the present case that the petitioner had to submit his joining by 30.07.2015, but he had submitted his application for joining only on 01.09.2015, a fact which has not been refuted by the learned counsel for the petitioner.

Having regard to the facts and circumstances of the case, this Court finds that since the petitioner neither submitted his joining in time nor had prayed for extension of time for joining, his candidature has rightly been cancelled, thus I do not find any merit in the present writ petition, hence the present writ petition stands dismissed.
