JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Arwal P.S. Case No. 173 of 2016, registered under Section 302, 307/34 of the Indian Penal Code.

The accusation is that on 04.09.2016, while the informant was present at her verandah, in the meantime, her mother-in-law Onik Raj and brother-in-law Ajit Kumar came there and Onik Raj, mother-in-law of the deceased, lit fire to her saree in which she sustained burn injury, when she raised alarm then her husband and other villagers came and extinguished the fire. Thereafter, she was taken to Appolo Burn Hospital, Kumharar, Patna for treatment. Later on, she died on 22.09.2016.

No.4813 of 2017 (2) dt.28-02-2017 2/2 Learned counsel for the petitioner submits that the occurrence is said to be held on 04.09.2016 and F.I.R. was lodged on 17.09.2016 and she died on 22.09.2016. In the meantime, her re-statement was recorded on 18.09.2016 in which she has not made any allegation against the petitioner. The petitioner having no criminal antecedent is in custody since 20.09.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 173 of 2016.
