The petitioner apprehends his arrest in connection with Warisaliganj P.S. Case No.447 of 2018 registered under Sections 420, 406 and 384/34 of the Indian Penal Code. The accusation is that for the construction of 'Sauchalaya' under 'Lohiya Swachh Bihar Abhiyan', 131 persons applied for the construction of 'Sauchalaya'. The petitioner along with Bindu Devi and Rina Devi, who were also engaged in the said scheme, illegally realized Rs.100/- each from 60-70 beneficiaries in the name of Jeo tagging. Thereafter, the petitioner illegally realized Rs.2000/- from each of the beneficiaries in between 30.11.2018 to 06.12.2018.

Further submission is that in the case diary, which is upto paragraph-31 till 29.12.2018, none has stated about taking the money by the petitioner for the construction of 'Sauchalaya' under 'Lohiya Swachh Bihar Abhiyan'.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Nawada, in connection with Warisaliganj P.S. Case No.447 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
