Although petitioner is named in the fardbeyan of the informant but from perusal of the same with naked eye, it would appear that the name of petitioner was subsequently inserted in the first information report. Moreover, no specific overt act has been attributed against the petitioner, who is in jail custody since 10.09.2015.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S.Case No. 356 of 2015.
