JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-05-2015 Petitioner is languishing in custody since 04.04.2013 in a case registered for the offences punishable under Sections 147, 148, 302, 307, 323, 324, 325, 341, 504, 34 of the Indian Penal Code.
It is alleged that all accused persons including the petitioner came variously armed when Mahabir Roy inflicted injury with Gupti on the lower portion of the abdomen of the wife of the informant who subsequently succumbed to the injuries. Co-accused Mahabir Rai and Lal Babu Roy assaulted the informant. The petitioner is alleged to have assaulted with Dab causing injuries on the head of Jamindar Roy.
It is submitted by learned counsel for the petitioner that there is no accusation against the petitioner to have made any overt act on the wife of the informant. The injury report of Jamindar Roy contained in Annexure-2 reflects
Patna High Court Cr.Misc. No.617 of 2014 (3) dt.15-05-2015 2/2 two lacerated injuries over both parietal region though petitioner alleged to have caused injuries with sharp cutting weapon. The final opinion with regard to the injury has not been incorporated in the case diary.
Considering the fact that there is no accusation against the petitioner to have made assault to the victim, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc Additional Sessions Judge-I, Bhojpur, Ara in connection with Sessions Trial No. 310 of 2013, arising out of Barhara P.S. Case No. 56 of 2013.
